After the applicability of Central Administrative Tribunal Act 1985 in the Union Territory of J&K, the cases pertaining to service matters in respect state Government employees in the High court of J&K have been shifted to the Central Administrative Tribunal. A total of 16335 no. of cases have been shifted from Jammu wing of J&K high court to the CAT. However, a peculiar situation has been
created for the employees after the shifting of cases. The Government has decided to have bench of CAT in Jammu and Srinagar respectively but no judges have been transferred to either Jammu or Srinagar bench and the High court has already refused to hear these cases, the J&K Government employees whose cases were pending and those who want to approach the court in urgent service related matter have nowhere to go.
According to the sources of the THE PUBLISH, the cases pending in the High Court of J&K had hearing dates upto March 2020, however there is no clarity when and where these cases
shall be heard. According the sources, the High Court shall continue to hear service related matters of all autonomous bodies including JKPSC, cases relating to Jammu University and Central University and the cases related to SBI, NABARD and other state owned Banks. All the matter which are related to J&K Government and its employees shall be heard by the CentralAdministrative Tribunal. The Lawyers of J&K High Court may take up the matter with the Government for early setting up of Tribunal Bench in Jammu and Srinagar so that the employees can get justice in case of genuine issues.
